GoCloud is operated by kam ("kam", "we", "us"). GoCloud is the trading name of the service. By creating an account or using the platform you enter into an agreement with kam.

By registering, subscribing to a plan, or continuing to use GoCloud you agree to these terms. If you use GoCloud on behalf of an organisation you confirm you have authority to bind that organisation; if you use it as an individual you confirm you are of legal age to enter a contract.

GoCloud provides cloud API infrastructure, storage and file management, compute and network resources, workspace collaboration tools, usage metering, entitlement enforcement and subscription billing. Available features and quotas depend on the plan you select.

You must provide accurate account and billing information and keep it up to date. You are responsible for keeping your credentials and API keys confidential and for all activity carried out under your account.

You must not use GoCloud:

• for any unlawful purpose, or in breach of any applicable law or regulation;
• to send spam, run fraudulent schemes, or distribute malware;
• to infringe the intellectual property, privacy or other rights of any person;
• to interfere with the security or integrity of the service — including probing, port scanning, penetration testing without written permission, scraping, or circumventing quotas, rate limits or entitlement checks;
• to resell, redistribute or sublicense the service outside the terms of your plan.

We grant you a limited, non-exclusive, non-transferable right to use GoCloud within the limits of your selected plan. You must not reverse engineer, decompile or attempt to derive the source code of the platform.

You retain ownership of the files, data and content you upload. You grant us a limited licence to host, store, transmit and process that content solely to operate and provide the service to you. You are responsible for holding the rights necessary to store and process the content you upload.

kam retains all ownership of the GoCloud platform and all associated intellectual property, including software, dashboards, documentation and branding. No rights are transferred to you other than the licence described above.

We work to keep GoCloud available and reliable, but we do not guarantee uninterrupted or error-free operation. Maintenance, upstream provider incidents and factors outside our control may affect availability.

Plans are billed monthly or annually in advance and renew automatically until cancelled. Cancellations take effect at the end of the current billing period; upgrades apply immediately and downgrades apply at the next renewal. Usage above your plan quota may incur overage charges as shown in your billing portal.

Payment, billing, currency, tax and refund mechanics are handled by our payment provider. Please see the Paddle Checkout Buyer Terms and our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Where practical we will notify you first and give you a chance to fix the issue. On termination you may export your data for 30 days, after which it may be deleted.

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not permit exclusion.

You indemnify kam against claims arising from your content, your unlawful use of the service, or your breach of these terms.

We may update these terms; material changes will be notified in the app or by email. You may not assign this agreement without our consent; we may assign it as part of a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control.

These terms are governed by the laws of the jurisdiction in which kam is established, and disputes are subject to the courts of that jurisdiction. Questions: support@gocloudplan.com.
